Purchase Terms & Conditions

Products & Metric Dashboards are available for 12 months from the date of purchase.

The Culture Think Tank offers programs/ products for which much or all of the value and most of the costs are derived up front; with offerings consisting primarily of virtual products sometimes bundled with other program features, there is nothing to return or exchange.

Product orders cannot be canceled or changed once they are placed.

Please note: Products may only be refunded prior to use (no Check In data collected); Purchasers must request a refund in 30 days. Any refund request will be considered in good faith by The Culture Think Tank and evaluated on a case-by-case basis.

Ownership of Data and Marketing Materials. All data generated by and comprising the Product(s) and associated Material(s) shall be the sole property of The Culture Think Tank, LLC (TCTT). All data generated shall be used by TCTT to aggregate comparative metrics, execute data models, generate trends, support research, and create learning/ support materials. Purchaser is granted the limited right to use the comparative metrics, trends, and research findings to support their organizations culture efforts.

Term. This Agreement shall be effective as of the Purchase Date and, shall extend for a period of one (1) year and shall continue for successive one (1) year terms thereafter (collectively, the “Term”) unless earlier terminated by mutual agreement by the Parties. Either Party may terminate this Agreement by sending the other Party written notice thirty (30) days prior to the end of the initial term or any renewal period. Termination for Cause may occur if: either Party breaches confidential information; or either party breaches any aspect of this agreement; and breaching party fails to remedy said breach within 30 days of written notification; or either Party’s dissolution of business; or either party ceases to conduct business.

Confidentiality. The Parties acknowledge that the Parties and their respective Representatives or agents may have access to Confidential Information of the other Party. Each Party agrees to not misappropriate, disclose, sell or otherwise use the Confidential Information in any manner (except as expressly authorized in this Agreement or in a separate writing signed by the affected Party).

Limited License. It is expressly understood that this Purchase only grants a limited license to utilize product(s) as defined by TCTT or any intellectual property making up the TCTT Product(s)) in accordance with this agreement, and training materials, certifications or support provided by TCTT.

No Joint Venture. Nothing in this Purchase, expressed or implied, is intended to or shall constitute the Parties hereto as entering into a partnership or becoming participants in a joint venture.

No Employment Contract. Nothing in this Purchase, expressed or implied, is intended to or shall constitute the Parties hereto as entering into an employment agreement.

Disputes. Any dispute or claim relating in any way to your use of any The Culture Think Tank products or services is to be adjudicated in the state or Federal courts of Johnson County, KS; you consent to exclusive jurisdiction and venue in these courts. We each waive any right to a jury trial.

Applicable Law. By using any TCTT Product, you agree that applicable federal law, and the laws of the state of Kansas, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and The Culture Think Tank.

Site Policies, Modification & Severability. Please review our other policies, such as our General Terms & Conditions & Privacy Policies, posted on our website. These policies also govern your use of The Culture Think Tank Products & Services. We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
